For the purposes of this Forward Contract, the Underlying Asset shall mean an asset having unique characteristics, viz., title to one Non-residential premise (storeroom) which will be enlisted as a property (hereinafter – “Property”) after the building provisionally numbered preliminary (design) technical characteristics of which are given in this clause (hereinafter - " Non-residential premise (storeroom) "), being part of the Project of rresidential district with public premises on Vatutina Street, Vishnevoe city, Kyiv-Sviatoshynskyi district, Kyiv region. The sixth stage of Project. (hereinafter – “Project”).

The delivery date of the Underlying Asset is deemed to be the date when the Non-residential premise (storeroom) ownership rights are transferred to the Buyer in accordance with the Non-residential premise (storeroom) Deed. Acceptance shall be accomplished by execution of a delivery and acceptance certificate.

To purchase the Underlying Asset, the Buyer shall conclude an Non-residential premise (storeroom). Terms and methods of payment shall be set forth in the Non-residential premise (storeroom) Deed.

Until the full fulfillment of obligations under the contract of sale of property rights with LTD «AKVARELI DEVELOPMENT HOLDING» for the acquisition of the underlying asset.
