For the purposes of this Forward Contract, the Underlying Asset shall mean an asset having unique characteristics, viz., title to one non-residential unit, which will be enlisted as a property (hereinafter – “Property”) after the building provisionally numbered 004,11 being part of the "Construction of a residential complex with built-in non-residential premises in the area of the 75th building on the Yantarnaya str. in the city of Dnipro", the construction of which is carried out on a land plot with cadastral number 1210100000:04:168:0176 (hereinafter -"Building Object "). Construction of the Building Object t is carried out on a land plot, the rights of the Seller to which are certified by the Land Lease Agreement concluded between Dnipropetrovsk City Council and PE “BUILDING INITIATIVE” dated 13.10.2009 and attested by a notary public.

The delivery date of the Underlying Asset is deemed to be the date when the Non-residential premise ownership rights are transferred to the Buyer in accordance with the Non-residential premise Deed. Acceptance shall be accomplished by execution of a delivery and acceptance certificate.

To purchase the Underlying Asset, the Buyer shall conclude an Non-residential premise. Terms and methods of payment shall be set forth in the Non-residential premise Deed.
